Terms and Conditions for Rental Equipment

These Terms and Conditions apply to all equipment rentals from Kicksled Tromsø. By renting from us, you agree to follow the terms outlined below. Please read them carefully before making a rental agreement.

1. Introduction

Welcome to Kicksled Tromsø. By renting equipment from us through our website or other means, you agree to comply with and be bound by these Terms and Conditions . If you do not agree with these Terms, you should not rent any equipment from us.

2. Rental Agreement

  • Rental Period: The rental period begins on the date you take possession of the equipment and continues until the equipment is returned to us or the rental period ends, whichever comes first. The rental period is specified in your rental confirmation.
  • Rental Fees: You agree to pay all rental fees as specified in the rental agreement. Fees are due at the time of rental unless otherwise agreed upon. Additional charges may apply for late returns, damage, or loss.

3. Equipment Use

  • Permitted Use: You agree to use the equipment solely for its intended purpose and in accordance with any instructions provided. You may not use the equipment for any illegal purposes or in a manner that could damage it.
  • Maintenance and Care: You are responsible for the maintenance and care of the equipment during the rental period. Any required maintenance should be reported to us immediately.
  • Prohibited Actions: You must not alter, modify, or repair the equipment without our prior written consent.

4. Delivery and Return

  • Delivery: If we provide delivery services, we will arrange for the equipment to be delivered to the address specified in your rental agreement. Delivery charges may apply.
  • Return: You must return the equipment in the same condition as received, normal wear and tear excepted. Any damage or loss will be subject to additional charges as outlined in these Terms.

5. Damage and Loss

  • Responsibility: You are responsible for any damage to or loss of the equipment that occurs during the rental period, including but not limited to theft, fire, or accidental damage.
  • Charges: In the event of damage or loss, you agree to pay for repairs or replacement of the equipment. The cost will be assessed based on the extent of the damage or the replacement value of the equipment.

6. Injury and Liability

  • Assumption of Risk: You acknowledge that the use of rented equipment may involve risks, including but not limited to physical injury or property damage. By renting the equipment, you voluntarily assume all risks associated with its use.
  • Release of Liability: To the fullest extent permitted by law, Kicksled Tromø, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any injury, loss, or damage that occurs during the use of the rented equipment. This includes, but is not limited to, personal injury, property damage, or any consequential or incidental damages.
  • Indemnification: You agree to indemnify, defend, and hold harmless Kicksled Tromsø, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to any injury or damage resulting from your use of the rented equipment.

7. Cancellation and Refunds

  • Cancellation Policy: Cancellations must be made 24 hours before the scheduled rental period to receive a full refund. Cancellations made less than 24 hours may be subject to a cancellation fee.
  • Refunds: Refunds for unused rental time are not provided unless otherwise agreed upon.

8. Limitation of Liability

To the fullest extent permitted by law, Kicksled Tromsø shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the rental of equipment. Our liability is limited to the amount paid by you for the rental of the equipment.

9. Termination

We reserve the right to terminate or suspend the rental agreement and demand immediate return of the equipment if you breach any of these Terms or if we determine, in our sole discretion, that it is necessary for any reason.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles. Any disputes arising from or related to these Terms, or the rental of equipment shall be resolved in the courts located in Norway.
